If you are an existing customer and have an urgent operational, technical, safety, power, or facility-related issue, you should use the emergency, service, or support contact method provided in your agreement with JDC.

Optional Arbitration Provision — Counsel Review Required
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the website shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring claims in small claims court where permitted or seek injunctive or equitable relief for misuse of intellectual property, unauthorized access, security threats, or other urgent matters.
The arbitration shall be administered by the American Arbitration Association under its applicable rules. The arbitration shall take place in [New York County, New York] unless the parties agree otherwise or applicable law requires a different location.
You and JDC agree that any dispute resolution will take place only on an individual basis. Class actions, class arbitrations, private attorney general actions, representative actions, and consolidated proceedings are not permitted to the fullest extent allowed by law.
You understand that, if this arbitration provision applies, you and JDC are waiving the right to a jury trial and the right to participate in a class or representative action.

21. Time Limit for Claims

To the fullest extent permitted by law, any claim arising out of or relating to these Terms or the website must be brought within one (1) year after the claim arises, or the claim will be permanently barred.

They do not replace or modify any separate written agreement, proposal, statement of work, purchase order, service contract, employment agreement, confidentiality agreement, or other agreement between you and JDC.
